Welcome to Breevo Australia (“Breevo”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) apply to your use of our website (www.breevo.com.au) and any purchase of products or services from Breevo, whether online or through any authorised channel.

By accessing our website or purchasing our products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please discontinue use of our website and services.

1. Eligibility & Account Registration

You must be at least 18 years old, or the age of majority in your state or territory, to use our website or make a purchase.
If you create an account, you must provide accurate, current and complete information and keep your login credentials secure. You are responsible for all activity that occurs under your account.

2. Products, Pricing & Availability

We make every effort to display accurate product descriptions, specifications, pricing, and availability.
However:

  • Colours may appear differently depending on device settings

  • Product measurements may vary slightly

  • Stock availability is subject to change without notice

All product prices are listed in AUD and include GST unless stated otherwise. Shipping fees are calculated at checkout.

We reserve the right to:

  • Modify or discontinue products at any time

  • Limit quantities to any person or household

  • Correct errors or inaccuracies without prior notice

3. Orders & Acceptance

When you place an order, you are making an offer to purchase. An order is only accepted once we issue an Order Confirmation.

  • Stock unavailability

If we cancel an order after payment is received, you will receive a full refund.

4. Australian Consumer Law (ACL) – Consumer Guarantees

Our goods come with non-excludable guarantees under the Australian Consumer Law (ACL).

You are entitled to:

  • A replacement or refund for a major failure

  • Compensation for any reasonably foreseeable loss or damage

  • Repair or replacement if the goods fail to be of acceptable quality and the failure is not major

Nothing in these Terms excludes, restricts or modifies your rights under the ACL.

5. Returns, Refunds & Warranty

Your purchase is subject to our Refund Policy, which complies with the ACL.

You may be entitled to:

  • Repair

  • Replacement

  • Refund

depending on whether the issue is major or minor under the ACL.
Change-of-mind returns are offered at Breevo’s discretion (see Refund Policy for full details).

Breevo products may also include voluntary manufacturer warranties, which operate in addition to ACL rights.

6. Payment & Billing

You agree to provide accurate payment and billing details.
By submitting payment information, you confirm that:

  • You are authorised to use the payment method

  • The information provided is correct

  • You will pay all charges incurred, including shipping and taxes

Fraudulent or unauthorised transactions may result in cancellation of your order.

7. Shipping, Delivery & Risk

Delivery timeframes are estimates only and may vary.
We are not liable for delays caused by:

  • Couriers

  • Weather events

  • Customs

  • Any circumstances outside our control

Risk of loss or damage passes to you once the order is delivered to the address nominated at checkout unless otherwise required by the ACL.

8. Intellectual Property

All content on our website—including images, logos, text, product names, graphics, and videos—is the property of Breevo Australia or its licensors and protected under Australian copyright, trademark, and IP laws.

You may not:

  • Modify

  • Distribute

  • Reproduce

  • Repost

  • Use our trademarks

without our written permission.

9. Third-Party Services & Links

Our website may include links or access to third-party tools or websites (including Shopify and payment gateways).
We do not control or endorse third-party services and are not responsible for:

  • Their content

  • Their privacy practices

  • Any losses or damages arising from their use

Your use of third-party services is at your own risk and subject to their terms.

10. Feedback, Reviews & User Content

By submitting reviews, comments, ideas, or feedback (“User Content”), you grant Breevo a worldwide, royalty-free licence to use, reproduce, publish, modify, or display such content for business purposes.

You agree not to submit content that is:

  • Defamatory, misleading or offensive

  • Infringing on intellectual property

  • False, unlawful, or harmful

We may moderate or remove content at our discretion.

11. Prohibited Activities

You agree not to:

  • Violate any Australian laws or regulations

  • Harm or harass others

  • Upload viruses, malware or malicious code

  • Scrape, crawl or extract website data without permission

  • Interfere with website security

Violation may result in account termination and potential legal action.

12. Disclaimer of Warranties

To the extent permitted by law:

  • We do not guarantee uninterrupted or error-free operation

However, this disclaimer does NOT apply to your rights under the Australian Consumer Law (ACL).

13. Limitation of Liability (ACL Compliant Version)

To the maximum extent permitted by law:

  • Breevo is not liable for any indirect, incidental or consequential losses

  • We limit our liability for non-ACL claims to the re-supply of the relevant service or the cost of re-supply

This clause does not limit rights and remedies available under the ACL.

14. Indemnity

You agree to indemnify Breevo against losses arising from:

  • Your breach of these Terms

  • Your unlawful use of our website

  • Your violation of third-party rights

15. Governing Law

These Terms are governed by the laws of Australia and the State of Queensland.
You agree to submit to the jurisdiction of Queensland courts.

16. Changes to Terms
